Order: Appeal allowed, order of Judge Brant set aside and the order of District Judge Gypps restored. No order as to costs in respect of the Defendant's application. Section 11 order in respect of the Defendant's costs assessed at nil, with liberty to the parties to come back. Defendant's costs to be assessed in accordance with the Community Legal Services (Costs) Regulations 2000. Hearing of the money claim to come back before another Circuit Judge, but not Judge Brant. Application to appeal to the House of Lords refused.
