S.I. No. 95/1968:

POISONS ACT, 1961 (PARAQUAT) REGULATIONS, 1968.

POISONS ACT, 1961 (PARAQUAT) REGULATIONS, 1968.

The Minister for Health, in exercise of the powers conferred on him by sections 14 and 16 of the Poisons Act, 1961 (No. 12 of 1961) hereby makes the following Regulations:--

1. These Regulations may be cited as the Poisons Act, 1961 (Paraquat) Regulations, 1968.

2. In these Regulations--

"the poison" means the substance declared to be a poison for the purposes of these Regulations;

"authorised person" means a manufacturer of the poison, a wholesaler of the poison, a registered pharmaceutical chemist, a registered dispensing chemist and druggist, a registered druggist, a licentiate of Apothecaries Hall, and a person for the time being licensed under subsection (1) of section 2 of the Poisons and Pharmacy Act, 1908.

3. Paraquat and its salts shall be a poison for the purposes of these Regulations.

4. The poison, except in a solid substance containing not more than five per cent paraquat salts, shall not be distributed, supplied, sold or offered or kept for sale by any person other than an authorised person.

5. The poison shall not be distributed, supplied, sold or offered or kept for sale except--

(a) when secured in the sealed container as supplied by the manufacturer,

(b) there is legibly written on the container the word "Poison" and a warning that the contents should not be taken, should be kept out of the reach of children, should not be repacked from the container and that the container should be destroyed when empty.

6. These Regulations shall be enforced and executed by--

(i) officers of the Minister for Health,

(ii) officers of the Minister for Agriculture and Fisheries,

(iii) the Pharmaceutical Society of Ireland and its officers, and

(iv) health authorities and their officers.

7. Offences under Section 17 of the Poisons Act, 1961 , in relation to these Regulations may be prosecuted by--

(i) the Minister for Health,

(ii) the Pharmaceutical Society of Ireland, and

(iii) health authorities.

8. These Regulations shall come into operation on 6th May, 1968.

EXPLANATORY NOTE.

The effect of these Regulations is to restrict the distribution, sale, etc., of Paraquat and its salts (except in a solid substance containing not more than five per cent paraquat salts), to persons entitled to sell other poisons and to specify certain precautions to be observed as to packaging and labelling.
