GS v Secretary of State for Work & Pensions [2024] UKUT 4 (AAC) (4 December 2023)


A First-tier Tribunal judge's reasons for refusing permission to appeal to the Upper Tribunal included reasons for dismissing the Appellant's appeal against a decision of the Secretary of State. These reasons were additional to those given in the First-tier Tribunal's statement of reasons for dismissing the appeal. The additional reasons were not to be taken as part of the Tribunal's reasons for dismissing the Appellant's appeal (R (Bancoult) v Secretary of State for Foreign and Commonwealth Affairs [2007] EWCA Civ 498). It was also uncertain whether the additional reasons were those of the two-member panel that dismissed the Appellant's appeal.
