AP v Secretary of State for Work and Pensions (ESA) (Tribunal procedure and practice - evidence) [2017] UKUT 304 (AAC) (20 July 2017)
Appellant’s refusal to consent to disclosure of medical records to FTT best not seen as a breach of the duty to co-operate with the tribunal (EB v SSWP (ESA) [2015] UKUT 358 (AAC) doubted). However, such a refusal may make it more difficult for appellant evidentially to make out their case.
