THE INDUSTRIAL TRIBUNALS

CASE REF: 6609/09

CLAIMANT: Nigel Darling

RESPONDENT: Nortel Networks UK Ltd (In Administration)

DECISION

The claimant's unfair dismissal claim is well-founded. It is ordered that the respondent shall pay the sum of £350 to the claimant in respect of that unfair dismissal.

Constitution of Tribunal:

Employment Judge: Employment Judge Buggy

Members: Mr E Grant

Mr B Hanna

Appearances:

The claimant was not present or represented.

The respondent was not represented.

REASONS

1. We announced our decision at the end of the hearing. At the same time we gave brief oral reasons for that decision.

2. For costs reasons, the respondent had decided not to be represented at this hearing

3. In advance of the hearing, this claimant had provided a written statement. In that written statement, he drew attention to what he asserted were the negative psychological effects, and the general misery, which he had suffered as direct or indirect results of this dismissal .

4. In the circumstances of this case, it has been unnecessary for us to arrive at definitive conclusions as to the accuracy or otherwise of each of the assertions which are set out in that document. We have however noted that the document is an impressively eloquent and forthright reminder of the negative effects which can occur within the context of a redundancy-related dismissal, regardless of the extent, or lack of extent, of any relevant direct economic loss.

5. The law of unfair dismissal constrained this tribunal from entertaining any claims in respect of loss other than financial loss. (Under the relevant legislation, compensation in respect of an unfair dismissal cannot include compensation for loss other than financial loss).

6. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.

Employment Judge:

Date and place of hearing: 5 April 2017, Belfast.
