WHALE FISHERIES ACT, 1937. FISHERIES ACTS, 1842 TO 1935. BY-LAW No. W.F. 1.

WHALING : CLOSED AREAS AND CLOSE SEASON.

I, Séamas Ó Riain, Minister for Agriculture, by virtue and in exercise of the powers vested in me by the Whale Fisheries Act, 1937 (No. 4 of 1937), and of every other power enabling me in this behalf, do make and ordain the following By-Law :--

(1). It is prohibited to kill any baleen whale, during any period of the year

(a) in the Atlantic Ocean north of 40° South Latitude and in the Davis Strait, Baffin Bay and Greenland Sea ;

(b) in the Pacific Ocean cast of 150° West Longitude, between 40° South Latitude and 35° North Latitude ;

(c) in the Pacific Ocean west of 150° West Longitude, between 40° South Latitude and 20° North Latitude ;

(d) in the Indian Ocean north of 40° South Latitude.

(2). It is prohibited to kill any baleen whale in any waters south of 40° South Latitude except during the period from the 8th day of December to the 7th day of March following, both days inclusive, provided that in the whaling season 1937-38 the period shall extend to the 15th day of March, 1938, inclusive.

(3). It is prohibited to kill any grey whale in any part of the sea outside the exclusive fishery limits of Saorstát Éireann, during any period of the year.

(4). The Interpretation Act, 1923 (No. 46 of 1923), applies to the Interpretation of this By-Law in like manner as it applies to the interpretation of an Act of the Oireachtas. In this By-Law " baleen whale " means any whale other than a toothed whale ; " grey whale " means any whale known by the name of grey whale, California grey, devil fish, hard head, mussel digger, grey back or rip sack.

(5). This By-Law may be cited for all purposes as the Whale Fisheries By-Law No. W.F. 1, 1937.

(6). Clause 1 of this By-Law shall come into force on the 1st December, 1937, and the remaining provisions shall come into force on the first day of August, 1937.
