Explanatory Note

(This note is not part of the Order)

1. This Order provides for the transfer of certain categories of staff who are in the service of the Inner London Education Authority ("ILEA") immediately before the abolition of that authority on 1st April 1990.

2. Certain staff were designated in the Education (Inner London Education Authority) (Staff Transfer) Order 1990 (S.I. 1990/59). This Order provides for further designations in relation to the London Residuary Body of other named persons, and of persons in the classes or categories set out in article 5(2) of this Order. Further categories of persons are added to Schedule 3 to S.I. 1990/59 which designates persons in relation to the inner London councils mentioned in that Schedule.

3. S.I. 1990/59 is also amended by substituting the period from 29th September 1989 to 28th February 1990 for the former date in article 3(1)(a). As amended that order designates certain categories of persons employed by ILEA at any time during that period and still so employed on 31st March 1990.

4. The effect of designation is that the contract of employment between the member of staff and ILEA is treated from the abolition of ILEA as if originally made between that member of staff and the successor employer; there is no termination of, or change in the terms of, the contract of employment.

(2)

S.I. 1990/59; certain provisions of that order are subject to the provisions of this order: see Article 3(3) thereof.
